O SUPOSTO BEM JURÍDICO SAÚDE PÚBLICA TUTELADO NO ARTIGO 28 DA LEI 11.343/2006

RESUMO

O objetivo do artigo é analisar se o bem jurídico saúde pública tutelado pelo artigo 28 da Lei 11.343/2006 é realmente o correto bem protegido. A partir do método dedutivo, analisa-se o conceito do bem jurídico, o contexto histórico da legislação de drogas, cominando na guerra às drogas adotada pelo Brasil e suas consequências. Como resultado desse movimento, observa-se que a alteração da nova lei de drogas resultou na criminalização da pobreza. Entretanto a forma apropriada de solucionar o problema seria a regulamentação do uso, para efetivamente proteger a saúde dos cidadãos, valendo-se de esferas menos agressivas do direito.

ABSTRACT

The purpose of the article is to analyze whether the public health legal interest protected by article 28 of Law 11.343 / 2006 is really the correct protected legal. From the deductive method, the concept of the legal interest is analyzed, the historical context of drug legislation, combining the war on drugs adopted by Brazil and its consequences. As a result of this movement, it is observed that the change in the new drug law resulted in the criminalization of poverty. However, the appropriate way to solve the problem would be the regulation of use, to effectively protect the health of citizens, using less aggressive spheres of law.
