A ELOQUÊNCIA DO CORPO NA COGNIÇÃO DO DIREITO CONSIDERAÇÕES A PARTIR DO CASO MINISTÉRIO PÚBLICO VERSUS MUNICÍPIO DE MOCOCA/SP E JANAÍNA APARECIDA QUIRINO

RESUMO

O artigo trabalha a informação como bem ambiental fundamental a concreção constitucional, sobretudo aos valores contidos na Carta Magna brasileira, tais como, dignidade da pessoa humana, direitos da personalidade, privacidade, intimidade, entre outros, além daqueles que referem-se ao direito processual como contraditório e ampla defesa. O direito material se compõe das informações trazidas aos autos do processo, de maneira a se operacionalizar por intermédio do processo, de maneira que a informação, portanto, torna-se bem ambiental, vez que ela é capaz de alterar a realidade do ambiente em que é proferida ou disseminada. Para tanto, valer-se-á do método dedutivo, bibliográfico com a análise do caso em tela para fazer apontamentos quanto a eloquência da informação e a capacidade de cognição do ouvinte.

ABSTRACT

The article works the information as fundamental environmental good the constitutional concretion, mainly to the values contained in the Brazilian Federal Constitution, such as, dignity of the human person, personality rights, privacy, intimacy, among others, besides those that refer to procedural law as contradictory and ample defense. The material law is composed of the information brought to the file of the process, so as to be operationalized through the process, so that information becomes, therefore, environmentally good, since it is capable of altering the reality of the environment in which is pronounced or disseminated. To do so, it will use the deductive, bibliographic method with the analysis of the case on screen to make notes as to the eloquence of the information and the capacity of cognition of the listener.
