O presente artigo científico se propõe, de modo coeso,a analisar os marcos fundantes da hermenêutica jurídica, com especial atenção à hermenêutica filosófica, haja vista os elementos cultivados em seu bojo e sua pertinência com o objetivo geral do artigo, a saber: a sobrevivência dos preceitos da teoria da justificação jurídica formulada por Robert Alexy em face ao movimento de uniformização de julgados e ao desvelar hermenêutico. Logo, distancia-se da avaliação que paira sobre a correção da teoria alexyana, para se perguntar sobre a continuidade de um dos seus aspectos, a justificação jurídica. Merece destacar que o presente artigo não deseja fornecer uma resposta polivalente, mas, sobremodo, a mensuração de (in)aplicabilidade. Utilizou-se, para o desenvolvimento desta presente pesquisa, o método indutivo, operacionalizado pelas técnicas de conceitos operacionais e da pesquisa bibliográfica.

ABSTRACT

This research paper proposes, cohesively, to examine the foundational frameworks of legal hermeneutics, with special attention to philosophical hermeneutics, given the culturedelements in its core and its relevance to the general objective of the article, namely: the survival of the precepts of thet heory of legal justification formulated by Robert Alexy in the face to the movement to standardize judged and hermeneutic unveiling. There fore, distance from the review that hangson the correctness of the theory alexyanato Wonder about the continuity of one of its aspects, the legal justification. It deserves mentioning that this articledoes not want to provide a multipurpose response, but greatly, measuring the (in) applicability.
