A moderna cultura jurídica expressa o fenômeno histórico de que cada época reproduz uma prática jurídica específica vinculada às relações sociais e às necessidades humanas. Atualmente, devido aos impactos provenientes do “espaço-tempo mundial", expressos na conjunção de problemas ambientais e na mundialização da economia, se presencia uma crise na cultura jurídica, vive-se o deslocamento de modelos de fundamentação e a transição para novos paradigmas de conhecimento, de representação institucional e de representação social. Estes são fluxos que refletem na efetivação da Justiça. Sendo assim, o arcabouço normativista da moderna teoria jurídica convencional é pouco eficaz e não consegue atender a extensão competitiva das atuais sociedades globalizadas. Desse modo, as novas necessidades e conflitos precisam de “novas” formas de direitos que desafiam e põem em dificuldade a dogmática jurídica tradicional, seus institutos formais e materiais e suas modalidades individualistas de tutela.

ABSTRACT

The modern legal culture expresses the historical phenomenon that every time you reproduce a specific legal practice linked to social relations and human needs. Currently, due to impacts from the "space-time" world, expressed in the conjunction of environmental problems and globalization of the economy, it witnesses a crisis in legal culture, live the displacement models of reasoning and the transition to new paradigms of knowledge , representing institutional and corporate representation. These are flows that reflect the realization of justice. Thus, the normative framework of conventional modern legal theory is ineffective and fails to meet the extension of the current competitive globalized societies. Thus, the new needs and conflicts need "new" forms of rights that challenge and put in difficulty the traditional legal doctrine, its institutes and their formal and material modes individualistic guardianship.
