A PROTEÇÃO À DIGNIDADE DA PESSOA HUMANA E AS MEDIDAS PROVISÓRIAS Nº 664/2014 E 665/2014: UMA ANÁLISE À LUZ DA VEDAÇÃO AO RETROCESSO SOCIAL

RESUMO

O presente artigo objetiva analisar as Medidas Provisórias publicadas em dezembro de 2014, que preveem restrições a alguns direitos sociais por meio da ampliação dos requisitos necessários à concessão de benefícios, tomando por base o princípio da vedação ao retrocesso social. Será avaliada a importância da proteção aos referidos direitos, considerando-se que qualquer limitação que se imponha aos mesmos constitui, ao menos em última instância, violação ao princípio constitucional da dignidade da pessoa humana, dotado de elevado status dentro do atual cenário do constitucionalismo pátrio (Neoconstitucionalismo). A verificação da aplicação do conceito da “reserva do possível” é indubitável, sobretudo por constituir justificativa para as referidas medidas.

ABSTRACT

The present article aims to analyze the Provisional Measures published in December of 2014, that declared restrictions to some social rights by extending the requirements necessary for the granting of benefits, based on the principle of the prohibition of social regression. Will be analyzed the importance of the protection of the rights mentioned, considering that any limitation imposed on them is, at least ultimately, a violation of the constitutional principle of the human dignity, endowed with a high status within the current scenario of national constitutionalism (Neoconstitutionalism). Checking application of the concept of the "reserve of the possible" is undoubted, especially by constitute justification for such measures.
