USUCAPIÃO FAMILIAR: BENEFÍCIO OU PREJUÍZO?

O presente trabalho tem por escopo realizar um breve estudo sobre a alteração trazida pela Lei 12.424/2011, a qual regulamenta o Programa “Minha Casa - Minha Vida” do Governo Federal, que incluiu no Código Civil Brasileiro, o artigo 1.240-A, introduzindo no ordenamento jurídico uma nova espécie de usucapião, a chamada Usucapião Familiar, também conhecido como Usucapião por Abandono do Lar. Discutir-se-á a aplicação do mencionado instituto, bem como, os posicionamentos quanto a se tratar de um beneficio ou um prejuízo o seu acréscimo à legislação vigente, dando ênfase aos inúmeros questionamentos de ordem material, processual e constitucional, levantados em torno do presente tema. Debater-se a, ainda, quanto as diferenças frente as demais modalidades de usucapião, o que de relevante essas alteração trouxeram ao direito, inovação ou retrocesso.

ABSTRACT

The present work has the purpose to make a brief study on the changes introduced by Law 12.424/2011, which regulates the " My House - My Life" from the Federal Government, which included the Brazilian Civil Code, Article 1240-A, introducing the legal system a new kind of prescription, the call adverse possession family, also known as adverse possession by desertion. The application of the mentioned institute will discuss up-as well as placements as it is a benefit or a detriment to increase its current legislation, emphasizing the numerous questions of material, procedural and constitutional order, raised around the this theme. Struggling to even, as the differences across the other types of adverse possession, which of these changes brought to the relevant law, or reverse innovation.
