PAISAGEM CULTURAL AMAZÔNICA: RELEVÂNCIA E FUNDAMENTAÇÃO JURÍDICA

O trabalho tem histórico no patrimônio cultural brasileiro, com visão fundamental no valor da memória, natureza e cultura, evoluindo para uma retrospectiva constitucional sobre bens culturais e sítios paisagísticos. Avançando, centra-se na paisagem, com os seus conceitos, para ao final dar a devida ênfase ao cerne do texto – a paisagem cultural amazônica. O objetivo do presente trabalho e o reconhecimento do valor da paisagem cultural dentro da região amazônica, considerando-se as peculiaridades da natureza exuberante desta área territorial. Iniciou-se o estudo a partir da Portaria n. 127, de abril de 2009, editada pelo IPHAN, que tratou da chancela da Paisagem Cultural Brasileira, almejando-se que haja um reconhecimento e respectiva chancela da Paisagem Cultural Amazônica.  Considerou-se, para tanto, além da juridicidade, que circunda o tema, aspectos legais, sociais, intelectuais e econômicos do modo de ser e viver amazônico, orientados pelos rios e florestas, com reflexos nos belos panoramas. Sendo a paisagem patrimônio cultural brasileiro, nada obsta ao reconhecimento de paisagens regionais belas e majestosas. A metodologia utilizada está na revisão da doutrina jurídica ambiental cultura e no acervo legislativo respectivamente ao tema, os quais serão analisados para a estruturação do trabalho. O resultado provável está no reconhecimento de uma paisagem cultural amazônica, concluindo-se com a possibilidade jurídica, científica, social e econômica do assunto enfocado.

ABSTRACT

The work has a history in the Brazilian cultural heritage, with fundamental view on the value of memory, nature and culture, evolving into a constitutional retrospective on cultural goods and landscaped sites. Moving forward, focuses on the landscape, with its concepts, to give emphasis to the heart of the text - the Amazon cultural landscape. The aim of this work and the recognition of the value of the cultural landscape in the Amazon Region, considering the peculiarities of the exuberant nature of this land area. The study began from the Order no. 127, April 2009, published by IPHAN, which dealt with the seal of the Brazilian Cultural Landscape, aiming that there is a recognition and its seal of Amazon Cultural Landscape. It was considered, therefore, beyond legality which surrounds the subject, the legal, social, intellectual and economic aspects of the way of being and living in Amazon, guided by rivers and forests, reflected in the beautiful panoramas. As the landscape Brazilian cultural heritage, nothing shall prevent the recognition of beautiful and majestic regional landscapes. The methodology used is the review of the environmental legal doctrine and culture to the legislation respectively to the subject, which will be analyzed for the structuring of work. The likely outcome is the recognition of an Amazon cultural landscape, concluding with the legal, scientific, social and economic feasibility of the focused subject.
