A fundamentalidade dos direitos sociais: uma análise sob a perspectiva do direito social à moradia adequada

O presente trabalho tem por objetivo estudar as características do direito social à moradia na Constituição Federal Brasileira, abordando os aspectos relativos à sua caracterização como direito fundamental e os efeitos decorrentes dessa identificação. Para tanto, são analisados os dois aspectos de fundamentalidade, formal e material, dos direitos sociais, dando ênfase na análise relativa ao direito à moradia. As características da fundamentalidade, nessa dupla perspectiva, se mostram identificadas no direito à moradia, o que culmina por estender a esse direito social todo o tratamento privilegiado do regime jurídico dos direitos fundamentais, incluindo a irradiação de sua carga axiológica, sua imediata aplicabilidade e sua proteção como cláusula pétrea.

ABSTRACT

The present work aims to study the characteristics of social right to adequate housing in the Federal Constitution, including the aspects of its characterization as a fundamental right. For this purpose, will be analyzed the two aspects of fundamentality, formal and material, of the social rights, with emphasis on the analysis on the right to adequate housing. The characteristics of fundamentality, on this double perspective, are identified on the right to adequate housing, which culminates to extend to this social right all the privileged treatment of the legal regime of fundamental rights, including its immediate applicability and its immutable status.
