EVOLUÇÃO E CONCRETIZAÇÃO DO DIREITO FUNDAMENTAL A PROTEÇÃO DO PATRIMÔNIO NACIONAL IMATERIAL.

RESUMO

O presente estudo traz a evolução histórica da proteção do patrimônio cultural imaterial no plano internacional, como algo intangível, mas essencial à memória e identidade passou a ser protegido. Apresentou-se a contribuição brasileira cuja proteção aos bens culturais imateriais foi pioneira, com o DECRETO Nº 3.551, DE 4 DE AGOSTO DE 2000, três anos antes da Convenção para a Salvaguarda do Patrimônio Cultural Imaterial. A proteção dos bens culturais imateriais inovou abarcando a cultura a partir dos saberes, modos de fazer, agir, celebrações dentre outros, para além da pedra e do cal. Reconhecer o patrimônio cultural imaterial é reconhecer a diversidade e identidade daquilo que perpassa pela alma e consolida os direitos culturais.

ABSTRACT

This study brings the historical evolution of the Intangible Cultural Heritage’s protection at an international level, as something intangible but essential to memory and identity to become protected.  A Brazilian contribution, where protection of Intangible Cultural Heritage was pioneer, with Decree No. 3551, OF AUGUST 4TH, 2000, happened three years before the Convention for the safeguarding of Intangible Cultural Heritage. The protection of Intangible Cultural Heritage inovated the culture when it included knowledge, ways of doing and acting, celebrations, among others, beyond “stone and lime”. To recognize the Intangible Cultural Herritage is to recognize the identity of what permeates the soul and consolidates cultural rights.
