O SUICÍDIO ASSISTIDO NA ESFERA DOS DIREITOS FUNDAMENTAIS: ANÁLISE DA AUTONOMIA DA VONTADE NA SOCIEDADE DISCIPLINAR

RESUMO

O presente artigo tem a pretensão de analisar o direito ao suicídio assistido. Os países que o proíbem apoiam sua impossibilidade no fato de a lei garantir o direito à vida. Esse direito à vida, por sua vez, colide com o direito à dignidade humana, pilar das Constituições democráticas. Entretanto, é de se avaliar se o reconhecimento de tais direitos nos ordenamentos internos não foi, na verdade, um aperfeiçoamento das técnicas de controle do homem que, disciplinado, é livre apenas à medida que suas ideias não vão de encontro com as ideologias das estruturas do poder. O estudo em apreço, portanto, investigará como se comporta a autonomia da vontade na sociedade disciplinar por intermédio da influência exercida pelo poder normalizador perante a sociedade no que diz respeito à proibição do suicídio assistido, uma vez que o reflexo do poder inserido neste contexto afeta sobremaneira a liberdade de escolha do indivíduo que deseja abreviar a própria morte.

ABSTRACT

This article purports to analyze the right to assisted suicide. Countries that forbid the assisted suicide support its impossibility on the fact the law guarantee the right to life. This right to life, in its turn, conflicts with the right to human dignity, pillar of democratic constitutions. However, it is necessary to evaluate whether the recognition of their rights in domestic legislation was not, in fact, an improvement of the technical control of the man, disciplined, is free only to the extent that their ideas will not meet with the ideologies of the state. This study, therefore, will investigate how behaves the autonomy of will in the disciplinary society, through the influence of the normalizing power about the prohibition of assisted suicide, since the reflection of the power inserted in this context greatly affects freedom of choice of the individual who wishes to shorten his own death.
