RESUMO

O presente trabalho científico tem como ponto principal o estudo dos processos administrativos previstos na legislação de trânsito para apuração das infrações e aplicação das penalidades de cassação da Carteira Nacional de Habilitação e da suspensão do direito de dirigir, os quais serão analisados sob o prisma dos princípios essenciais que norteiam o Direito Público. Busca-se com isto aprofundar o conhecimento acerca dos procedimentos administrativos que tramitam perante os órgãos de trânsito, relacionando-os com as determinações legais e com os preceitos atinentes ao Direito Administrativo. A importância da regulamentação do trânsito e necessidade da aplicação das penalidades aos infratores é indiscutível e incontestável, desde que precedida pelas garantias do devido processo legal.

ABSTRACT

This scientific work has as main point of the study of administrative proceedings under the laws of transit for investigation of infractions and the penalties of forfeiture of the driver's license and suspension of driving rights, which will be analyzed through the prism of the principles that guide the Public Law. Searching with this deeper knowledge of administrative procedures that move before the transit agencies, linking them with the legal and precepts relating to Administrative Law. The importance of the regulation of transit and need for applying the penalties for violators is undisputed and indisputable, provided it is preceded by the guarantees of due process.
