O PROBLEMA DA CAPTURA DOS AGENTES REGULADORES E A NATUREZA JURÍDICA DA RESPONSABILIZAÇÃO DA LEI ANTICORRUPÇÃO

O presente artigo pretende examinar a natureza jurídica da responsabilização da pessoa jurídica prevista pela Lei Anticorrupção. A Lei prevê uma responsabilização administrativa, mas tem todos os indícios de ser uma responsabilização penal disfarçada. O objetivo está inserido na problemática questão da captura dos agentes reguladores, que são cooptados por pessoas jurídicas, que serão submetidas aos rigores da Lei Anticorrupção. Destarte, a análise parte das Agências Reguladoras, da teoria da captura dos seus agentes, para na sequência examinar a responsabilização da Lei Anticorrupção e sua verdadeira natureza jurídica. O seu enquadramento no direito administrativo sancionador pode trazer vantagens, eis que possibilita a punição das pessoas jurídicas, ampliando o combate à corrupção, ainda que sua responsabilização seja substancialmente de natureza penal.

ABSTRACT

This article intends to examine the legal nature of the liability of the legal entity provided for by the Anti-Corruption Law. The Act provides for administrative accountability but has all indications of criminal liability in disguise. The objective is inserted in the problematic question of the capture of the regulatory agents by legal persons, who will be subjected to the rigors of the Anti-Corruption Law. Therefore, the analysis starts at the Regulatory Agencies and at the capture theory in order to examine the liability of the Anti-Corruption Law and the legal nature of it, whether administrative or criminal. Its framework in the Administrative Law sanctioning can bring advantages, since finally allows the punishment of legal entities, expanding the fight against corruption, even if substantially of criminal nature.
