RESUMO

A nova ótica mundial, pautada por uma base ética e de moralidade, impõe cada vez mais ao Estado e aos cidadãos, uma postura “conformadora”, com valores e princípios que levam a construção de uma sociedade digna e coesa. Os questionamentos passam inexoravelmente por uma base constituída de argumentos pautadas na postura ética e moral do próprio Estado, que nessa constituição de valores a serem perseguidos, busca tergiversar de seu caminho constitucional, e buscar através de distorções valorativas de suas atribuições, imiscuir-se do seu papel principal de dar o exemplo a ser perseguido pelos seus cidadãos. Nesse compasso, verificamos a necessidade de um re-alinhamento constitucional, o qual chamamos de Compliance Constitucional, o qual revela a distância dos valores do Estado brasileiro e o próprio Estado, e a tentativa de reaproximação deste Estado com a norma constitucional de forma coerente e contemporânea.

ABSTRACT

The new world view, based on an ethical and moral basis, increasingly imposes on the State and its citizens a "conforming" attitude, with values and principles that lead to the construction of a society that is dignified and cohesive. The questioning passes inexorably through a base constituted of arguments based on the ethical and moral position of the State itself, that in this constitution of values to be pursued, seeks to misrepresent its constitutional path, and seek through value distortions of its attributions, its main role of setting the example to be pursued by its citizens. In this measure, we call this Constitutional Compliance, which reveals the distance between the values of the Brazilian State and the State itself, and the attempt to reconnect this State with the constitutional norm in a coherent and contemporary way.
