RESUMO

O artigo trabalha com a abordagem ao aplicativo de trocas de informação, whatsapp1 como meio de comunicação, integração e entretenimento, nessa ampla margem de possibilidade de utilização, por vezes o manejo desse instrumento atende interesses escusos e ilícitos de maneira que a informação como bem ambiental fundamental à concreção constitucional, sobretudo aos valores contidos na Constituição Federal de 1988 merece especial atenção a essa tecnologia. Assim, sendo o avanço tecnológico célere, e, por outro, o direito ser mais atuante de modo mais repressivo do que preventivo, é que decisões judiciais reprimem de tal modo o uso da plataforma de informações que acaba por restringir o acesso à informação decorrente do uso indevido/ilegal por parte de uma minoria. O caso é pertinente e atual, vez que o Supremo Tribunal Federal se posicionou em relação a determinações judiciais que interrompem as atividades do aplicativo. [...]

ABSTRACT

The article deals with the approach to the information exchange application, whatsapp as a means of communication, integration and entertainment, in this wide margin of possibility of use, sometimes the handling of this instrument attends to illicit interests and in such a way that information as an environmental good fundamental to the constitutional concretion, especially to the values contained in the Federal Constitution of 1988 deserves special attention to this technology. Thus, since the technological advance is swift and the law is more effective in a more repressive than preventive way, it is that judicial decisions so repress the use of the information platform that restricts access to information wrongful / illegal use by a minority. The case is pertinent and current, since the Federal Supreme Court has ruled in relation to judicial determinations that interrupt the activities of the application. [...]
