DELEGAÇÃO DE SERVIÇOS PÚBLICOS E REGULAÇÃO: A RELAÇÃO ENTRE A ATIVIDADE REGULATÓRIA E A POSIÇÃO JURÍDICA DO USUÁRIO

A presente pesquisa busca discorrer acerca dos serviços públicos delegados, a respectiva regulação estatal e a posição jurídica do usuário. Tal postura científica se dá em razão da ausência do diálogo entre o Direito Público e o Direito Privado acerca da figura do usuário, fato que empurrou o conceito de serviço público para uma crise conceitual e material. Tais problemas levam a crer na possibilidade de um novo caráter híbrido do usuário de serviço público, com a ampliação da liberdade dos agentes delegados, concessionário ou permissionário, sem perder de vista a responsabilidade inerente à condição de prestador de serviços públicos.

ABSTRACT

The present research seeks to discuss the delegated public services, the respective state-owned regulation and the legal position of the user. Such a scientific position is due to the absence of a dialogue between public and private law about the figure of the user, fact that pushed the concept of public service into a conceptual and material crisis. Such problems lead one to believe in the possibility of a new hybrid character of the public service user, with the extension of the freedom of delegated agents, concessionaires or permission holder, without losing sight of the responsibility inherent in the status of publics services provider.
