REGULAÇÃO SETORIAL NO BRASIL E TEORIA DA CAPTURA DE AGÊNCIAS: LINEAMENTOS HISTÓRICOS, CONCEPÇÃO E DESAFIOS PARA UM MODELO REGULATÓRIO INDEPENDENTE

RESUMO

O presente trabalho analisa as agências reguladoras no Brasil, abordando, especificamente, suas origens históricas, suas funções no modelo regulatório nacional, e os desafios para exercerem seu papel com independência. No início, o trabalho apresenta a influência das experiências regulatórias em outros países, notadamente nos Estados Unidos. Em seguida, são expostos os principais marcos regulatórios verificados em nosso país. Posteriormente, são analisadas as funções e o contexto atual das agências reguladoras nacionais. Por fim, com base na teoria da captura, são apontados os principais problemas e as eventuais soluções para que se desenvolva um modelo regulatório independente em nosso país.

ABSTRACT

This paper analyzes the sectorial regulation agencies in Brazil, specifically aiming their historical origins, their roles in the national regulatory model and the challenges to exercise their function with independence. First the essay shows the influence of the regulatory experiences in other countries, notably in the United States. Then, it exposes the main regulatory marks verified in our country. Afterwards examines the functions and the current context of national regulatory agencies. Finally, based on the capture theory, the paper points out the main problems and the possible solutions in order to develop an independent regulatory model in our country.
