A LEI ANTICORRUPÇÃO E SEU IMPACTO TRANSFORMADOR: REALIDADE OU ILUSÃO?

O presente trabalho busca analisar os tópicos centrais relativos à Lei Anticorrupção (Lei n. 12.846/2013), bem como seu Decreto Regulamentador (Decreto 8.420/2015). Para tanto, demonstrará como o diploma legislativo se acomoda em um paradigma de intercruzamento entre direito e ética. Em seguida, serão avaliadas as principais mudanças trazidas pela Lei e por que elas se inserem nesse novo paradigma. Por fim, serão debatidos os “pontos cegos” da Lei, os quais significam os possíveis óbices para a sua integral aplicação. O presente trabalho será conduzido a partir do estudo bibliográfico, calcado no método-hipotético dedutivo, ao debater os fundamentos que levam a crer que a Lei Anticorrupção possui um caráter transformador. Mais do que respostas definitivas, as conclusões obtidas serão significativas para pontuar reflexões acerca da interpretação do referido diploma e como ele irá se acomodar no contexto normativo brasileiro.

ABSTRACT

The following article aims to analyze the main topics concern to the Anti-Corruption Act (Act n. 12.846/2013), and its Regulatory Ordinance n. 8.420/2015. Therefore, we will show how the Legislative Act stands in a paradigm that intersects Law and Ethics. Then, we will evaluate the main changes provided by the Act and why they are fit in this paradigm. In the end, we will debate the Act’s “blind side”, that means possible obstacles for the Act’s full enforcement. The following article is conducted by the bibliography study, based on the hypothetical-deductive method, in order to debate the arguments that endorse the Anti-Corruption Act as a source of changes. More than achieve clear answers, the conclusions will provide significant reflections about the Act’s interpretation and how it is going to fit in a Brazilian normative scenario.
