O MEIO AMBIENTE LABORAL E AS CONSEQUÊNCIAS DA PEJOTIZAÇÃO NAS RELAÇÕES DE TRABALHO

Résumé

Objetivos: o objetivo desta pesquisa é o de analisar as consequências do uso da pejotização nas relações de trabalho e como esta afeta o meio ambiente laboral; bem como verificar como o a justiça do Trabalho e o Supremo Tribunal Federal tipificam este fenômeno e verificar se este instituto apresenta benefícios e/ou malefícios nas relações trabalhistas e no meio ambiente do trabalho.

Metodologia: a metodologia que se adotará nesta pesquisa é a do método dedutivo, que parte de análises gerais para se chegar a um resultado particular. Quanto aos meios a serem utilizados na pesquisa, utilizar-se-á de referências bibliográficas, com uso da doutrina, legislação e jurisprudência, bem como os documentos dispostos na rede mundial de computadores; quanto aos resultados, buscar-se-á trazer um resultado qualitativo.

Resultados: a pesquisa chegou aos seguintes resultados: a pejotização contribui diretamente para a precarização do trabalho no Brasil, por degradar as relações de trabalho e o meio ambiente laboral. Isso ocorre em virtude de que há uma promoção de uma visão menos voltada para o social e com maior ênfase no privilégio e empoderamento do empregador, proporcionado, em parte, pelo posicionamento do Supremo Tribunal Federal em temas correlatos à pejotização, bem como pela força do empregador em estabelecer essa forma de labor e que fragiliza o obreiro a manter-se nessa situação.

Contribuições: a pesquisa contribui para fortalecer entendimentos jurídicos e doutrinários à respeito da pejotização, no âmbito trabalhista, alertando para o fato de que essa é uma forma irregular de vínculo laboral, pois configura fraude à legislação vigente e se constitui em um engodo jurídico e ainda que, embora traga benefícios financeiros ao empreendedor (pois reduz os encargos trabalhistas), traz como consequência, graves prejuízos ao trabalhador, à sua saúde, ao seu bem estar; pois precariza suas condições laborais e o exclui de um sistema de proteção vigente e que foi estabelecido há oitenta e dois anos pela CLT e ampliado pela atual Constituição Federal de 1988

ABSTRACT

Objectives: The objective of this research is to analyze the consequences of the use of pejotização in labor relations and how it affects the work environment; as well as to verify how the Labor Court and the Federal Supreme Court typify this phenomenon and to verify whether this institute presents benefits and/or harms in labor relations and the work environment.

Methodology: The methodology adopted in this research is the deductive method, which begins with general analyses to arrive at a specific result. The research tools will utilize bibliographical references, including doctrine, legislation, and case law, as well as documents available on the Internet. The results will be qualitative.

Results: The research yielded the following conclusions: pejotização (self-employment contracting) directly contributes to the precariousness of work in Brazil by degrading labor relations and the work environment. This occurs due to the promotion of a less socially focused perspective and a greater emphasis on the privilege and empowerment of the employer, driven in part by the position of the Supreme Federal Court on issues related to pejotização, as well as by the employer's influence in establishing this form of labor, which weakens workers' ability to remain in this situation.

Contributions: The research contributes to strengthening legal and doctrinal understandings regarding pejotização, in the labor field, warning of the fact that this is an irregular form of employment relationship, as it constitutes fraud to current legislation and constitutes a legal deception. Furthermore, although it brings financial benefits to the entrepreneur (as it reduces labor costs), it brings as a consequence, serious harm to the worker, to their health, to their well-being; as it makes their working conditions precarious and excludes them from a current protection system that was established eighty-two years ago by the CLT and expanded by the current Federal Constitution of 1988.
