O DIREITO QUÂNTICO E SUA INTERSEÇÃO COM A GESTÃO E A INOVAÇÃO NOS DEPARTAMENTOS JURÍDICOS EMPRESARIAIS

RESUMO

O Direito não pode ser visto como uma ciência unicamente humana, na qual as situações postas são analisadas meramente como conflitos sociais. A abordagem do Direito deve conter um viés racional, sendo assim o resultado de uma visão multifocal, que resulta no Direito Quântico. O direito também pode – e deve – ser objeto de uma abordagem sob a ótica da ciência exata, da matemática, da estatística: é a aplicação da Jurimetria na análise de resultados e/ou de históricos de demandas, judicializadas ou não. A Jurimetria deve ser entendida como a “estatística aplicada ao Direito”, sendo um reflexo da utilização de sistemas jurídicos que permitem criar estatísticas e obter dados comparativos. Portanto, a visão do Direito como ciência com caracteres racionais, seja no seu fundamento como na operacionalização e interpretação de sua atividade, é procedimento que inquestionavelmente auxilia na gestão dos serviços jurídicos e da própria sociedade empresária. O método utilizado foi o da revisão bibliográfica e análise do conteúdo de outras fontes.

ABSTRACT

Law cannot be seen as a uniquely human science, in which the situations presented are analyzed merely as social conflicts. The Law approach must contain a rational bias, thus being the result of a multifocal vision, which results in Quantum Law. Law can also - and should - be the subject of an approach from the point of view of exact science, mathematics, statistics: it is the application of Jurimetry in the analysis of results and / or history of demands, whether judicialized or not. Jurimetry should be understood as “statistics applied to Law”, reflecting the use of legal systems that allow the creation of statistics and obtain comparative data. Therefore, the vision of Law as a science with rational characters, both in its foundation and in the operationalization and interpretation of its activity, is a procedure that unquestionably assists in the management of legal services and the business society itself.
