ABUSO DE DIREITO E O CÓDIGO DE DEFESA DO CONSUMIDOR: UMA ANÁLISE DA COBRANÇA DIFERENCIADA DE PREÇOS À LUZ DO SUPERIOR TRIBUNAL DE JUSTIÇA

O presente trabalho realiza análise do atual entendimento da Corte Superior de Justiça no que diz respeito ao enquadramento, como prática abusiva, da diferenciação de preços para o pagamento em dinheiro em detrimento da retribuição financeira por meio de cartão de crédito. Para atingir tal finalidade, sintetiza a concepção utilizada quando do julgamento do Agravo Regimental no Recurso Especial n. 1.178.360/SP, em 05 de agosto de 2010, de inexistência de óbice legal quanto à distinção de preços, comparando-a com os fundamentos empregados no acórdão no Recurso Especial n. 1.479.039/MG, de 6 de outubro de 2015, pela caracterização de abuso de direito na prática de discriminação de valores. Com base nas cláusulas gerais da boa-fé e do enriquecimento sem causa, extraídas do tipo previsto pelo artigo 187 do Código Civil, procura-se avaliar a inexistência de taxatividade no rol de práticas abusivas elencado pelo artigo 39 da Lei n. 8.078/1990 (Código de Defesa do Consumidor), para embasar a classificação da conduta de distinção de preços como prática abusiva.

ABSTRACT:

This work brings about an examination over the Superior Court of Justice’s contemporary comprehension concerning the labeling of price discrepancy under the abusive practice category for rewarding money payment over credit card financial retribution. To attain this purpose, it synthesizes the notion employed during the appeal n. 1.178.360/SP, October 5^th, 2010, of lack of legal barrier regarding price disparity, in contrast with the subject matter discussed on trial n. 1.479.039/MG, October 6^th, 2015, where the price distinction practice was classified as law abuse. Based on article 187 of the Civil Code’s general clauses of good faith and unjust enrichment, it aims on evaluating the lack of thoroughgoingness of the abusive practices tabulation on article 39, Law n. 8.078/1990 (Consumer Protection Code), to establish the price differentiation conduct as an abusive practice.
