A ATIVIDADE EMPRESARIAL E SUA FUNÇÃO SOCIAL: A EFETIVAÇÃO DOS DIREITOS FUNDAMENTAIS

O direito empresarial, assim como os demais ramos do direito, recebe a irradiação dos princípios constitucionais, bem como em razão dessa submissão, é instado a buscar a efetivação dos direitos fundamentais. Trata-se do chamado processo de constitucionalização do direito, responsável por consagrar a normatização do Estado Democrático-Social, que tem por objetivo essencial a observância da dignidade da pessoa humana em detrimento da postura patrimonialista que inspirava o ordenamento jurídico. A atividade empresarial deve estar pautada pela observância aos ditames constitucionais e aos princípios norteadores do ordenamento jurídico, no propósito de efetivar direitos e alcançar os objetivos de maximização de lucros. A efetivação dos direitos fundamentais, desse modo, por meio das obrigações de função social, torna-se medida essencial à atividade empresarial porque diretamente relacionada à manutenção da própria empresa.

ABSTRACT

The business law, as well as other branches of law, receives irradiation of constitutional principles, and because of this submission, is urged to seek the realization of fundamental rights. This is the so-called process of constitutionalization of law, for consecrating the standardization of the Democratic-Social State, whose essential objective compliance with the dignity of the human person over the patrimonial approach that inspired the law. The business activity must be guided by adherence to constitutional principles and the guiding principles of the legal system, the purpose of carrying rights and achieve profit maximization goals. The enforcement of fundamental rights, thereby, through the obligations of social function, it is essential to measure business activity because it directly related to the maintenance of the company.
