RESUMO

O artigo traz reflexões sobre o Poder Judiciário e as modificações estruturais que ocorreram nesse poder no país, enfatizando-se a ‘reforma do judiciário’ que trouxe a obrigatoriedade de implementação da Justiça Itinerante. Entende-se nesse estudo que a Justiça Itinerante tornou-se um instrumento eficaz para o acesso à justiça, pois a reforma do Judiciário promovida pela EC 45-2004 evidencia a preocupação com a efetiva aplicação do direito de forma célere e isonômica, pelo menos em um discurso principiológico. Essa discussão, entretanto, evoca uma questão mais complexa sobre o acesso a justiça e mecanismos jurisdicionais para esse acesso, pois as dificuldades estão interrelacionadas. No presente artigo será enfocado apenas os aspectos conceituais em relação ao acesso a justiça, e um dos mecanismos instrumentais para esse acesso: a Justiça Itinerante.

ABSTRACT

The article reflects on the judiciary and the structural changes that occurred in that power in the country, emphasizing the 'judicial reform' that brought the mandatory implementation of the Justice Itinerant. It is understood in this study that the Justice Itinerant became an effective tool to access to justice, judicial reform as promoted by the EC 45-2004 shows concern for  the effective application of the law swiftly and isonomic at least principiológico a speech. This discussion, however, evokes a more complex issue of access to justice and judicial mechanisms for such access, because the problems are interrelated. In the present article is focused only on the conceptual aspects in relation to access to justice, and the instrumental mechanisms for such access: the Justice Itinerant.
