A CRIMINALIZAÇÃO DO SALÁRIO "POR FORA” E O PAPEL DO JUIZ DO TRABALHO

A prática do salário “por fora” é relativamente comum entre as empresas brasileiras. O salário “por fora” trata-se de ilícito trabalhista, mas também penal, na medida em que tipificado no art. 337-A do CP, relativo a sonegação de contribuição previdenciária, e a Lei n. 8.137/1990, referente ao crime contra a ordem tributária. O salário “por fora” acarreta grave prejuízo a sociedade, porque reduz a arrecadação dos encargos sociais e, consequentemente, prejudicada o financiamento da seguridade social. Necessária a articulação dos atores envolvidos na caracterização do salário “por fora”, com o objetivo de prevenir e punir essa prática, sobretudo a atuação do Juiz do Trabalho.

ABSTRACT

The practice of salary "out" is relatively common among Brazilian companies. The salary "out" it is unlawful labor, but also criminal, inasmuch as defined in art. 337-A of the Penal Code, relating to evasion of social security contributions, and the Law. 8137/1990 concerning the crime against the tax system. Salary "outside" causes serious injury to society, because it reduces the collection of social security contributions and thus undermined the social security financing. Necessary articulation of the actors involved in the characterization of wages "out" in order to prevent and punish this practice, especially the performance of Labor Judge.
