AS RAZÕES EPISTEMOLÓGICAS PARA INADMISSIBILIDADE DA PENA DE MORTE: UM ENSAIO A PARTIR DO FILME “A VIDA DE DAVID GALE”

O objetivo do presente artigo é analisar, a partir da Epistemologia, a possibilidade ou não de aceitação da pena de morte. Metodologicamente, caracteriza-se, quanto à abordagem, como qualitativo, baseado em fonte bibliográfica e documental, tendo como ilustração o filme “A vida de David Gale”. Quanto aos objetivos é exploratório, explicativo e descritivo. Como conclusão, entende-se ser impossível a concretização do conhecimento pleno da realidade e do alcance absoluto da verdade. Assim, nada justificaria a admissibilidade da aplicação da pena capital ao infrator, vez que esta sanção retira a possibilidade de recuperação do indivíduo tornando-o um ser eternamente culpado.

ABSTRACT

The objective of this article is to analyze, from the Epistemology, the possibility or not to accept the death penalty. Methodologically, the research is qualitative, based on bibliographic and documentary sources, using as an instrument “The life of David Gale” film.  As for the objectives, it is exploratory, explanatory and descriptive. In the end, it was concluded that it is impossible to believe in the knowledge possibility of reality’s in all aspects and the absolute reach of a truth. So, nothing would justify the admissibility of the application of capital punishment to the individual, because the death penalty removes the possibility of the individual recovery making it one be eternally guilty.
