LA SISTEMATIZACIÓN DEL ORDENAMIENTO INTERNACIONAL A PARTIR DE LA HUMANIZACIÓN DE LA AGENDA GLOBAL: EL PAPEL DE LA CORTE INTERNACIONAL DE JUSTICIA
Resumen
Objetivo: Esta investigación pretende analizar la humanización del Derecho Internacional en la Corte Internacional de Justicia, a través del estudio del caso de Ahmadou Sadio Diallo (República de Guinea vs. República Democrática del Congo), para rechazar los argumentos sobre la supuesta fragmentación del Derecho Internacional, reafirmando el carácter sistémico del orden internacional.
Metodología: La investigación es de carácter cualitativo, predominantemente bibliográfica y documental, guiada por la metodología de investigación hipotético-deductiva.
Resultados: Como resultado de esta investigación es posible identificar que la Corte Internacional de Justicia, principal órgano judicial de las Naciones Unidas, al tramitar y juzgar las demandas que involucran la protección internacional de los derechos humanos, no contribuye a la fragmentación del derecho internacional. Ello se debe a que la mera coexistencia de normas judiciales con jurisdicciones concurrentes no conduce a un desequilibrio en el derecho internacional.
Contribuciones: Este estudio contribuye al debate sobre la visión sistémica del derecho internacional, que permite una mayor cohesión y eficacia en el orden internacional. Esto significa que es posible identificar que el carácter humanista presente en la agenda global -y en la Corte Internacional de Justicia- orienta el derecho internacional hacia un único objetivo, que es la realización de la justicia internacional.

ABSTRACT
Objective: This research aims to analyze the humanization of International Law at the International Court of Justice, through the study of the case of Ahmadou Sadio Diallo (Republic of Guinea v. Democratic Republic of the Congo), in order to reject the arguments about the supposed fragmentation of international law, reaffirming the systemic character of the international order.
Methodology: The research, qualitative in nature, is predominantly bibliographic and documental, guided by the hypothetical-deductive research methodology.
Results: It is possible to identify as results of the present investigation that the International Court of Justice, the principal judicial organ of the United Nations, when processing and judging claims that involve the international protection of human rights, does not contribute to the fragmentation of international law. This is because the mere coexistence of court rules with competing jurisdictions does not lead to an imbalance in international law.
Contributions: The study brings as its contribution the discussion on the systemic vision of International Law, which allows for greater cohesion and effectiveness to the international order. This means that it is possible to identify that the humanist character present in the global agenda - and in the International Court of Justice - guides international law towards a single objective, which is the realization of international justice.
