A COOPERAÇÃO DO MERCOSUL PARA CONCRETIZAÇÃO DOS DIREITOS HUMANOS: DESAFIOS E POSSIBILIDADES

RESUMO

O Mercosul representa importante organismo internacional para o continente americano, posto que, além de suas finalidades institucionais para o desenvolvimento econômico e independência dos Estados Partes, também resguarda a proteção dos direitos humanos em seus compromissos. O bloco apresenta mecanismos importantes para promoção dos direitos fundamentais, porém os mesmos são obstaculizados por sua estrutura, o que implica a ausência de reconhecimento formal deste organismo como integrante do sistema internacional de proteção dos direitos humanos. Como a cooperação mercosulina não pode ser negligenciada, o presente trabalho, mesmo que sucintamente, analisa o comportamento deste organismo frente aos sistemas internacionais e sua atuação na proteção desses direitos. E por meio do método dedutivo, a partir de um levantamento bibliográfico, em obras e periódicos pertinentes à temática, é desenvolvida a discussão acerca da importância do bloco regional do Mercosul no engajamento para salvaguarda dos direitos humanos concluindo quais são seus desafios e possibilidades. O escrito é composto por introdução do tema, 03 (três) capítulos e a seção contendo as considerações finais.

ABSTRACT

The MERCOSUR represents an important international organism for the American continent, since, in addition to their institutional purposes for economic development and the independence of States Parties, also safeguards the protection of human rights in their commitments. The block has important mechanisms for the promotion of the fundamental rights, but they are hampered by their structure, which implies the absence of formal recognition of this organism as a member of the international system for the protection of human rights. As the Mercosur’s cooperation cannot be neglected, the present work, even though briefly, analyzes the behavior of this agency to the international systems and their practice in the protection of these rights. And by means of deductive method, from a bibliographical survey, in books and periodicals relevant to the subject is developed the discussion about the importance of the regional block Mercosur in the engagement for the protection of human rights concluding what are their challenges and possibilities. The writing consists of the introduction of the theme, 03 (three) chapters and the section containing the final considerations.
