Auxílio reclusão: uma releitura com base nos princípios constitucionais

Neste trabalho será feito um breve escorço sobre a Seguridade Social, sua divisão, princípios, e, especificamente no que se refere ao Regime Geral de Previdência Social, será abordado o benefício auxílio reclusão, suas características, destinatários, requisitos para concessão, enfim todas as suas especificidades, além de ser feita uma análise crítica sobre tal instituto, que muitas vezes é utilizado pela mídia para uma crítica ao Sistema Previdenciário Brasileiro de uma forma totalmente equivocada. Demonstrar-se-á que é um benefício que divide opiniões, mas, que ao contrário do que se prega, não pode ser considerado uma “bolsa bandido”, mesmo porque é destinado aos dependentes do segurado de baixa renda que for recolhido à prisão e não a este.

ABSTRACT

This work will be a brief foreshortening on Social Security, their division, principles, and specifically in relation to the General Regime of Social Security, the benefit will be addressed aid seclusion, their characteristics, recipients, requirements for granting finally all their specificities, as well as being a critical analysis of such institute, which is often used by the media to a criticism of the Social Security System, Brazilian in a totally misguided. It will demonstrate that it is a benefit that divides opinion, but that contrary to what is preached, can not be considered an "exchange bandit", because it is intended for dependents of the insured low income that is taken to prison and this not.
