La violación de los Derechos de los Inmigrantes en la Unión Europea

Resumo

RESUMEN

Ante las crueldades vislumbradas en el siglo XX, la sociedad internacional decidió proteger los derechos y libertades fundamentales de toda persona humana. A partir de ello, en el seno del Consejo de Europa, se aprobó el Convenio Europeo de Derechos Humanos, del cual todos los países de la Comunidad Europea son miembros; y el Tribunal Europeo de Derechos Humanos que es el órgano responsable de la aplicación del referido Convenio para llevar a cabo la protección de los derechos humanos. No obstante, en la actualidad, se evidencia el endurecimiento de políticas europeas de inmigración que contrastan con la protección de la dignidad, libertad, igualdad, solidaridad, ciudadanía y justicia entre todos los seres humanos, conforme a lo previsto en varios instrumentos internacionales. A partir de ello, esta investigación tiene como objetivo analizar la eficacia del Convenio Europeo de Derechos Humanos, en relación con los nacionales de terceros Estados, a partir de la jurisprudencia del TEDH; y verificar si la Directiva 2008/115/CE, de 16 de diciembre de 2008 viola a los derechos humanos de los inmigrantes irregulares.

ABSTRACT

First glimpsed the atrocities in the twentieth century, international society decided to protect the rights and freedoms of every human person. From this, the Council of Europe adopted the European Convention on Human Rights, which all European Community countries are members, and the European Court of Human Rights is the body responsible for implementing that Convention to carry out the protection of human rights. However, at present, are evidence of the tightening European immigration policies that stand against the protection of human dignity, freedom, equality, solidarity, citizenship and justice among all human beings, as provided for in international instruments. On this basis, this research is to analyze the effectiveness of the European Convention on Human Rights in relation to nationals of third countries, from the jurisprudence of the ECHR, and to verify whether the Directive 2008/115/EC of 16 December 2008 violates the human rights of irregular migrants.
