RESUMO

Trata-se de análise da Súmula 479 do Superior Tribunal de Justiça com a breve análise da evolução da teoria da responsabilidade civil, especialmente quanto aos critérios adotados no artigo 927, parágrafo único, do Código Civil (teoria do risco do negócio) e no artigo 14 do Código de Defesa do Consumidor (teoria objetiva), utilizando os julgados que precederam à sua redação final.

ABSTRACT

It involves analysis of Precedent 479 of the Superior Tribunal de Justiça with brief analysis of the evolution of the theory of liability, especially about the criteria adopted in Article 927, § single, of the Civil Code (theory of business risk) and Article 14 of the Code of Consumer Protection (objective theory) using the trials prior to its final version.
