A OMISSÃO NA DECLARAÇÃO DE INCONSTITUCIONALIDADE: ANÁLISE DO DISCURSO SOBRE O CABIMENTO DE EMBARGOS DE DECLARAÇÃO NAS DECLARAÇÕES DE INCONSTITUCIONALIDADE

RESUMO

O objeto do presente trabalho versa sobre a análise do discurso das decisões dos ministros do Supremo Tribunal Federal em embargos de declaração opostos contra a declaração de inconstitucionalidade que deixou de apreciar a modulação temporal dos efeitos por falta de requerimento das partes. O estudo parte da seguinte pergunta: cabe embargos de declaração, em sede de controle concreto, em face da não manifestação da Corte Constitucional brasileira sobre a modulação temporal dos efeitos nas declarações de inconstitucionalidade? Destaque-se que os embargos de declaração são o recurso oponível à decisão que apresenta omissão, contrariedade ou obscuridade, ao passo que a declaração de inconstitucionalidade de norma produz efeitos próprios, declarando nulos os atos produzidos com base na referida norma em razão do seu efeito ex tunc. Sendo assim, nossa hipótese consiste na possibilidade de provimento na oposição de embargos nas declarações de inconstitucionalidade quando não há pedido nos autos acerca da modulação temporal dos efeitos, por ser esta matéria de índole constitucional. Por fim, a presente pesquisa utiliza a matriz teórica de analise do discurso desenvolvida por Patrick Charaudeau.

ABSTRACT

The object of this paper talks about the speech analysis of judgments from Federal Supreme Court in the “Amendment of Judgment” directed against declaration of unconstitutionality that did not appreciated the temporal modulation of the effects due to the lack of requirement by the litigant. The study begins on the question if is suitable the use of “Amendment of Judgment” in thirst for concrete control opposite the absence of manifestation of Brazilian Constitutional Court about the temporal modulation of the effects in the declarations of unconstitutionality? it Should be highlighted that the “Amendment of Judgment” are  relied on against a decision that shows an omission,  contrariety or obscurity while the declaration of unconstitutionality of a norm produces its own effects by declaring null and void the acts done based on that norm because of its ex tunc effect. Therefore, our hypothesis consists in the impossibility of be upheld “Amendment of Judgment” in the declaration of unconstitutionality when there is no request in the proceedings about the temporal modulation of the effects. Finally, this research uses the theoretical matrix of speech analysis developed by Patrick Charaudeau.
