O DIREITO AO DESENVOLVIMENTO INTEGRAL EM FACE DA POLÍTICA NACIONAL DE RESÍDUOS SÓLIDOS

Resumo

RESUMO

A sociedade contemporânea está em constante transformação. Direitos individuais eram outrora considerados absolutos e intocáveis. Com o passar do tempo, outros direitos foram surgindo e compatibilizando com estes primeiros, tais como os direitos sociais, o direito ao desenvolvimento e, até mesmo, o direito ambiental. Dito isso, o presente artigo tem como enfoque, por meio de uma metodologia dedutiva e a partir de análises legislativas e doutrinárias, tratar da análise dos direitos difusos dentro dos direitos humanos, da teoria do desenvolvimento integral e da chamada responsabilidade compartilhada, para que se possa verificar de que forma a Política Nacional de Resíduos Sólidos contribuiu – ou se ainda contribui – para incutir na população a ideia de cidadania empresarial, tendo em vista a importância, in casu, do meio ambiente para essa e futuras gerações.

ABSTRACT

Contemporary society is constantly changing. Individual rights were once considered absolute and untouchable. Over time, other rights were counterbalanced with those individual rights, such as social rights, right to development and even environmental rights. That said, this article focuses, through a deductive methodology and on the basis of legislative and doctrinal analysis, to address the defense of these diffuse rights within the human rights context, the theory of full development and the so-called shared responsibility, so that it can be verified if the Brazilian National Policy of Solid Waste has contributed – or if it still contributes – to instilling in the population the idea of ​​corporate citizenship, considering the importance, in casu, of the environment for this and future generations.
