O processo eletrônico e a efetividade dos direitos fundamentais no contexto do acesso à justiça

RESUMO

Muito se discute hoje sobre a efetividade dos direitos fundamentais. E no presente trabalho será abordado especificamente o processo eletrônico, enquanto meio de acesso à justiça e realização da efetivação dos direitos fundamentais, pois o mundo cibernético é uma realidade da qual não há como retroceder, a informatização navida de cada cidadão é inquestionável e a cada dia que passa mais abrangente. O processo eletrônico por ser um tema muito novo, a bibliografia é escassa, mas os questionamentos são infinitos, até porque surgiu da prática do Judiciário e não das academias. Assim, o presente trabalho visa contribuir para uma reflexão acerca do assunto, visando a maximização de seus aspectos positivos e o apontamento dos aspectos desfavoráveis a fim de que os mesmos possam ser solucionados, bem como pretende contribuir com a doutrina que está sendo construída sobre o assunto.

ABSTRACT

There is debate today about the effectiveness of fundamental rights. And in this work will be addressed specifically the electronic process as a means of achieving access to justice and the enforcement of fundamental rights, because the cyber world is a reality from which there is no  turning back, computerization in the life of each and every citizen is unquestioned day more comprehensive. The electronic process because the subject was too new, the literature is scarce, but the questions are endless, because the practice arose not from the judiciary and academia. Thus, this paper aims to contribute to a reflection about the subject, aiming to maximize their positive aspects and bad aspects of the appointment so that they can be solved, and intends to contribute to the doctrine which is being built on the subject.
