DEFICIÊNCIAS E INSUFICIÊNCIAS DA RESPONSABILIZAÇÃO DAS EMPRESAS PELA VIOLAÇÃO À DIGNIDADE HUMANA NO SISTEMA INTERAMERICANO DE DIREITOS HUMANOS

Resumo

Objetivo: o presente artigo objetiva analisar as deficiências e insuficiências do marco regulatório da responsabilização das empresas pela violação à dignidade humana no âmbito do Sistema Interamericano de Direitos Humanos.

Metodologia: utilizam-se as pesquisas bibliográfica e documental, cujos resultados foram analisados pelo método dedutivo.

Resultados: no âmbito do Sistema Interamericano de Direitos Humanos, a posição consolidada é não considerar as empresas como sujeitos do Direito internacional, impedindo, portanto, a sua responsabilização.

Contribuições: evidencia-se a urgente necessidade de uma mudança de paradigma em prol da efetiva defesa da dignidade humana.

ABSTRACT

Objective: his article aims to analyze the shortcomings and insufficiencies of the regulatory framework of corporate accountability for the violation of human dignity of the Inter-American human rights protection systems.

Methodology: a bibliographic and documentary research was conducted, the results of which were analyzed by the deductive method.

Results: in the Inter-American Human Rights System the consolidated position is not considering companies as subjects of international law, thus preventing their accountability.

Contributions: there is an urgent need for a paradigm shift for the effective defense of human dignity.
