A VIOLAÇÃO DA ESTRUTURA CONCORRENCIAL: O EXERCÍCIO DA POSIÇÃO DOMINANTE E DO PODER DE MERCADO POR VIA DA VENDA CASADA

RESUMO

O trabalho desenvolvido aborda a tutela da ordem econômica nacional. Tem por objetivo segmentar esta proteção da estrutura mediante a sondagem da legislação pertinente e a possibilidade de sua aplicação em determinado momento concreto em que observada a possibilidade de violação da ordem jurídica desejada, no que diz respeito ao aspecto econômico. Aborda, portanto, condutas específicas como a livre iniciativa, a livre concorrência e a possibilidade de suas infringências pela posição dominante indevidamente exercida e exteriorizada em poder de mercado, tendo para tal prática a utilização da venda casada. Ao analisar estas hipóteses são conjugados textos de ordem constitucional e de legislação hierarquicamente inferior ao texto maior. Como resultado deste trabalho, espera-se conduzir o leitor a compreender parcela da estrutura concorrencial no Brasil, normas básicas que tutelam a livre concorrência e a hipótese de violação deste sistema por práticas consideras abusivas no mercado.

ABSTRACT

The work addresses the protection of national economic order. Aims to target this protection of the economic structure by probing the relevant legislation and the possibility of its application in certain concrete moment you observe potential violations of law required, with regard to the economic aspect. Addresses, so specific behaviors such as free enterprise, free competition and the possibility of infringements by their dominant position improperly exercised and externalized in market power, and to this practical use of bundling. By analyzing these hypotheses texts of constitutional order and hierarchically inferior to larger text legislation are conjugated. As a result of this work is expected to lead the reader to understand the plot of the competitive structure in Brazil, basic standards that protect free competition and potential infringement of this system by snag abusive market practices.
