RESUMO

O presente estudo busca analisar o trabalhador marítimo, para perquirir a possibilidade de incidência da legislação brasileira a tripulantes a bordo de navios de cruzeiros, quando prestam serviço embarcados em embarcação estrangeira de turismo. Pretende-se, inicialmente e como objetivo específico, abordar questões inicias quanto ao trabalhador marítimo, para concluir que aplicação do princípio do centro da gravidade, que afasta a aplicação da lei da bandeira da embarcação, deve ser interpretado com cautela para não representar uma afronta às normas internacionais.

ABSTRACT

The present study seeks to analyze the maritime crew in order to investigate the possibility of Brazilian legislation affecting crew members aboard cruise ships when they provide services on board a foreign tourism vessel. It is intended, initially and as a specific objective, to address initial questions regarding the maritime crew, to conclude that application of the principle of the most significant relationship, which removes the application of the law of the flag of the vessel, must be interpreted with caution so as not to represent an affront to international norms
