JUSTIÇA TARDIA COMO DENEGAÇÃO DA JUSTIÇA

RESUMO

O trabalho consiste na análise dos aspectos gerais que envolvem a prestação da atividade jurisdicional pelo Estado, com enfoque na necessidade de uma tutela adequada, justa e célere. Para tanto, abordou o conceito de jurisdição como espécie de serviço público, o monopólio da atividade pelo Estado e a exceção da arbitragem, bem como a instrumentalidade do processo, o acesso à justiça e novo preceito constitucional da razoável duração do processo. Também houve abordagem sobre os fatores que influenciam no atraso da prestação da tutela e, ainda, a demora da justiça como forma de exclusão social, tanto no aspecto cível quanto no criminal. Concluiu pela necessidade de uma prestação jurisdicional adequada, célere e justa, bem como que a intempestividade da justiça é forma de exclusão, e representa nada mais que a própria denegação da justiça.

ABSTRACT

The present work performs the study and analysis of general aspects involving provision of judicial activity by the state, focusing on the necessity of proper fair and expeditious protection. For this purpose, some main aspects are addressed, such as: the concept of jurisdiction as a kind of public service, the monopoly of state activity and the exception of the arbitration, the instrumentality of the process, the access to justice and new provision, as well as the reasonable duration of constitutional process. The study made also the approach on the factors influencing the delay in the delivery of guardianship and mainly the delay of justice as a form of social exclusion, both in in civil and criminal aspect. The conclusion points the need for an appropriate adjudication, swift and fair, as well as the untimeliness of justice as a form of exclusion, which represents, after all, nothing more than a denial of justice.
