A CONSTITUIÇÃO E A CONCEPÇÃO HILÉTICA DE NORMAS JURÍDICAS: Um olhar jusfilósofo a partir da Teoria Analítica

Esse artigo tem como objetivo geral demonstrar a possibilidade de aplicação da teoria analítica ao Direito Constitucional, principalmente para se analisar a efetividade da própria Constituição. Assim a problematização deste artigo é: a teoria analítica se aplica ao Direito Constitucional? O ponto fulcral, que buscamos demonstrar é que a teoria analítica pode ser utilizada para aclarar a linguagem utilizada no texto e os seus reflexos interpretativos. Assim, ressaltamos as distinções entre o texto e a sua normatividade, bem como os detalhes entre os planos semânticos e sintáticos das normas jurídicas e entre elas aquelas expressas de maneira locucionaria, ilocucionária ou perlocucionária.

ABSTRACT

This article has as general objective to demonstrate the possibility of applying the analytical theory to Constitutional Law, mainly to analyze the effectiveness of the Constitution itself. So the problematization is: Does analytic theory apply to Constitutional Law? The central point that we seek to demonstrate is that analytic theory can be used to clarify the language used in the text and its interpretive reflexes. In this passage, we emphasize the distinctions between the text and its normativity, as well as the details between the semantic and syntactic planes of legal norms, and among them those expressed in a locutionary, illocutionary or perlocutionary manner.
