TEORIA DOS JOGOS APLICADA AO DIREITO: DECISÕES ESTRATÉGICAS, RACIONALIDADE LIMITADA E DESAFIOS HERMENÊUTICOS
Resumo
Este artigo investiga a aplicação da Teoria dos Jogos ao Direito, considerando as interações estratégicas entre atores jurídicos em contextos como litígios civis, penalidades administrativas, processo penal e regulação estatal. A partir dos modelos formais propostos por Von Neumann e Nash, analisa-se como a racionalidade estratégica pode auxiliar na previsão de condutas e na formatação de políticas públicas, sem negligenciar os limites impostos por fatores morais, emocionais e institucionais. O estudo contempla também jurisprudência do Supremo Tribunal Federal e do Superior Tribunal de Justiça, além de exemplos práticos brasileiros.
