GOVERNANÇA DE ALGORITMOS DE IA - UMA ABORDAGEM A PARTIR DAS EPISTEMOLOGIAS DO SUL

Resumo

Objetivos: O artigo visa a trazer uma proposta de framework, de métrica e metodologia adequada à proteção dos direitos fundamentais dentro da estrutura de governança, de check and balances, levando em consideração as características específicas para o contexto sociocultural brasileiro, por meio de uma abordagem inclusiva, democrática e descolonial. Buscou-se traçar os principais parâmetros para uma proposta executiva de governança de IA específica para o contexto brasileiro e vocacionada para a justiça social, com foco na sustentabilidade ambiental e na diversidade.

Metodologia: A metodologia e as técnicas de investigação combinam a investigação teórica, relacionando-se com a metodologia de Michel Foucault denominada de teatro filosófico, buscando-se uma visão interdisciplinar e holística, e uma epistemologia multifacetada.

Resultados: a importância da governança digital sustentável, não se limitando apenas à busca de inovações tecnológicas e de competitividade em nível mundial, juntando-se o azul do digital ao verde ambiental, produzindo um círculo virtuoso entre natureza e tecnologia.

Contribuições: traz a elaboração de uma proposta de recomendação executiva para a governança de IA voltada ao Brasil, a partir de métricas e parâmetros para o Sul Global, na forma de um protótipo de design ético e regulamentar que poderá ser utilizado como um sandbox regulatório. Portanto, diante das especificidades do Brasil em termos de fragilidade institucional, ausência de uma Corte Constitucional e do histórico colonial, visa-se contribuir para a construção de um framework em IA adequado a tal realidade sociocultural, atingindo-se um nível forte de regulamentação.

ABSTRACT

Objectives: The article aims to bring a proposal for a framework, metrics and methodology suitable for the protection of fundamental rights within the governance structure of "check and balances, taking into consideration the specific characteristics for the Brazilian socio-cultural context, through an inclusive, democratic and decolonial approach. Furthermore, it sought to outline the main parameters for an executive proposal for AI governance specific to the Brazilian context and aimed at social justice, with a focus on environmental sustainability and diversity.

Methodology: The methodology and research techniques will combine theoretical research, relating to Michel Foucault's methodology called philosophical theater, seeking an interdisciplinary and holistic vision, and a multifaceted epistemology.

Results: the importance of sustainable digital governance, not limited only to the search for technological innovations and competitiveness at a global level, joining the blue of the digital to the green of the environment, producing a virtuous circle between nature and technology.

Contributions: it brings the elaboration of a proposal of an executive recommendation for AI governance aimed at Brazil, from metrics and parameters for the Global South, in the form of a prototype of ethical and regulatory design that can be used as a regulatory sandbox. Therefore, in view of Brazil's specificities in terms of institutional fragility, absence of a Constitutional Court, and colonial history, we aim to contribute to the construction of an AI framework suitable to such a socio-cultural reality, achieving a strong level of regulation.
