ACESSO AOS CARGOS E EMPREGOS PÚBLICOS PARA PESSOAS COM DEFICIÊNCIA: EM BUSCA DA MÁXIMA EFICÁCIA DA NORMA CONSTITUCIONAL

O presente texto científico apresenta uma análise sobre o acesso a cargos públicos das pessoas com deficiência, no âmbito interno e internacional, com vistas a promoção da máxima efetividade das normas constitucionais e uma interpretação “pro homine” do direito ao trabalho da pessoa com deficiência. Propõe-se uma leitura desse texto constitucional para efetiva inserção da pessoa com deficiência em cargos e empregos públicos, rompendo definitivamente com uma cultura e prática que inibem a construção emancipatória dos direitos humanos, de modo a alcançar uma sociedade mais justa, democrática e igualitária. Com base em perspectiva multidisciplinar e dados estatísticos, procurou-se demonstrar o quanto equivocado o modus operandi para inclusão da pessoa com deficiência no âmbito dos cargos e empregos públicos. Espera-se que a reflexão sobre os pontos abordados contribua para os operadores do Direitos possa dar maior efetividade ao comando constitucional, no sentido de fazer uma sociedade cada vez mais inclusiva, ensejando o desenvolvimento sustentável, inspirada na crença da absoluta prevalência da dignidade humana.

ABSTRACT

This scientific text presents an analysis on the access to public positions of persons with disabilities, both domestically and internationally, with a view to promoting the maximum effectiveness of constitutional norms and a pro homine interpretation of the right to work of the disabled person. It is proposed to read this constitutional text for the effective insertion of persons with disabilities into public positions and jobs, definitively breaking with a culture and practice that inhibit the emancipatory construction of human rights, in order to achieve a more just, democratic and egalitarian society. Based on a multidisciplinary perspective and statistical data, it was tried to demonstrate how mistaken the modus operandi for inclusion of the person with disability in the scope of the positions and public jobs. It is hoped that the reflection on the points addressed will contribute to the operators of the Rights can give greater effectiveness to the constitutional command, in the sense of making an increasingly inclusive society, promoting sustainable development, inspired by the belief in the absolute prevalence of human indentity.
