DIREITOS HUMANOS, DIREITO INTERNACIONAL E RELAÇÕES INTERNACIONAIS: UMA REFLEXÃO CRÍTICA DA TEORIA E APLICAÇÃO NO CONTEXTO CONTEMPORÂNEO

No contexto contemporâneo, a discussão nos foros regionais e mundiais sobre a proteção dos direitos dos indivíduos ganhou maior força, a partir do momento em que os Estados nacionais aceitaram debater o assunto não mais como questão exclusivamente interna. Isto alavancou o desenvolvimento normativo e institucional do Direito Internacional dos Direitos Humanos e do Direito Humanitário, ainda que em medidas diferentes, a um estágio inédito e elogiável. A aplicação das regras humanísticas na sociedade internacional mostra-se, contudo, ainda discriminatória e seletiva, o que ressalta o caráter peculiar do Direito Internacional, fortemente influenciado pelas Relações Internacionais e fundado no postulado da soberania dos Estados e nos princípios dela decorrentes. Com isso, o objetivo do artigo é situar a complexa relação que envolve os valores humanos no Direito Internacional, a partir de sua perspectiva westfaliana e realista-marxista que visa a contextualizá-los como produto de um processo histórico inserido em um sistema interestatal, regido pela lógica teoria da soberania e dinâmica prática do realismo político, o que difere diametralmente das estruturações jurídicas internas dos Estados.

ABSTRACT

In the contemporary context, the discussion in regional and global forums on individuals rights protection has gained more strength, from the moment that the national states have agreed to discuss the subject no longer as exclusively internal matter. This boosted the normative and institutional development of international human rights law and humanitarian law, although in different measures, to a new and praiseworthy stage. The application of humanistic rules in international society shows, however, still discriminatory and selective, which highlights the peculiar character of international law, strongly influenced by the International Relations and based on the principle of state sovereignty and the principles deriving from it. Thus, the objective of this article is to situate the complex relationship that involves human values in international law, from its Westphalian and realistic Marxist perspective that seeks to contextualize them as the product of a historical process inserted into an interstate system, governed by the logic theory of sovereignty and dynamic practice of political realism, which differs diametrically internal legal structuring of states.
