O MEIO AMBIENTE ECOLOGICAMENTE EQUILIBRADO E O DIREITO DE LIVRE INICATIVA PAUTADO NA ATIVIDADE EMPRESARIAL DENTRO DA ORDEM ECONÔMICA

Pretende-se com o presente trabalho trazer à tona discussão versada no aparente antagonismo existente entre dois direitos de extrema relevância para a ordem econômica na Constituição de 1988, quais sejam, o direito ao meio ambiente ecologicamente equilibrado e o direito da empresa pautado na livre iniciativa, especialmente em se considerando o desenvolvimento da sociedade, sua organização social e institucional que reverbera diretamente em necessidades materiais cada vez maiores, não desvencilhadas, portanto, de maior evolução da ciência e da tecnologia e especialmente, da satisfação de necessidades essenciais e do consequente crescimento das cidades sempre amparados na manutenção da existência digna, princípio supremo do nosso ordenamento jurídico, que somente se concretizará ante a interação de ambos os princípios que se dará a partir do desenvolvimento econômico sustentável.

ABSTRACT

The present work intends to bring to the fore a discussion of the apparent antagonism between two rights of extreme relevance to the economic order in the 1988 Constitution, namely, the right to the ecologically balanced environment and the right of the enterprise based on free enterprise , especially considering the development of society, its social and institutional organization that reverberates directly into ever greater material needs, not removed from the evolution of science and technology, and especially the satisfaction of essential needs and the consequent growth of the cities always supported in the maintenance of the dignified existence, supreme principle of our juridical order, that will only materialize before the interaction of both principles that will take place from the sustainable economic development.
