EXTENSÃO DA SUSPENSÃO DAS AÇÕES CONTRA SÓCIOS E AVALISTAS EM DECORRÊNCIA DO DEFERIMENTO DO PROCESSAMENTO DA RECUPERAÇÃO JUDICIAL

RESUMO

O presente trabalho busca abordar a recuperação judicial de modo sistemático e sem pretensão de exaurir o assunto. Mais precisamente, toca a ordem judicial de suspensão das ações e execuções contra  a empresa recuperanda com base no artigo 6º e alguns outros contidos na Lei Federal n.º 11.101/2005. Relativamente novo, este instituto ainda é objeto de grande controvérsia no Brasil, demandando maior discussão doutrinária e jurisprudencial para que se consolide a ideia de um princípio de proteção ao negócio. É certo que o tema tende a crescer em importância, com o crescimento do número de empresas em atividade no país, e as crises a que comumente estão sujeitas.

Abstract

The present written attempts to deal with judicial  recovery, in a systematically way and with no pretention to exhaust the issue. More precisely, touches the judicial order of suspension of all the actions andenforcements against the recovering firm, based on article 6 and some othersrelated in the Federal Law n. 11.101/2005.
