TELETRABALHO NO DIREITO COMPARADO: BRASIL E ARGENTINA

O presente artigo busca estudar o instituto do teletrabalho, haja vista as modernas tecnologias de informação e o momento pandêmico em que se encontra o mundo. Volta-se o estudo quanto a análise da legislação contemporânea do Brasil e da Argentina sobre o teletrabalho, sendo realizada uma comparação entre ambas. A partir desta comparação foi perceptível que o legislador argentino teve maior cuidado em prescrever os direitos fundamentais do teletrabalhador e os deveres do empregador, fatos alguns omissos na legislação brasileira. Com este texto pretende-se entender a evolução histórica e conceitual do instituto, bem como os aspectos relevantes de cada lei. A pesquisa utilizou o método dedutivo-dialético a partir da revisão bibliográfica. As contribuições científicas encontradas foram no sentido de que se faz necessário meditar sobre o teletrabalho, já que mediante a globalização tal regime se tornará mais atrativo aos trabalhadores e empregadores.

ABSTRACT

This article seeks the institute of teleworking, given the modern information technologies and the pandemic moment in which the world is. The study turns to an analysis of contemporary Brazilian and Argentine legislation on teleworking, with a comparison being made between both. From this comparison, it was noticeable that the Argentine legislator took greater care in prescribing the rights of the teleworker and the duties of the officer, facts that are missing in Brazilian legislation. This text aims to understand the historical and conceptual evolution of the institute, as well as the relevant aspects of each law. A research using the deductive-dialectic method from the bibliographic review. The contributions found were found in the sense that it is necessary to meditate on teleworking, since through globalization such a regime will become more attractive to workers and employers.
