O PRINCÍPIO DA FUNDAMENTAÇÃO DAS DECISÕES JUDICIAIS NA REALIDADE DOS TRIBUNAIS

As sociedades modernas têm sofrido grandes transformações com o avanço da globalização e das inovações tecnológicas. Essas mudanças impactam as relações sociais, a economia e a ordem jurídica dos países. A partir da Constituição de 1988, surgiram novas formas de interpretar o direito dando maior segurança e harmonia ao sistema. No Brasil, devido à existência de maiores demandas na sociedade e com os crescentes déficits fiscais, o Poder Judiciário ganhou relevância ao assumir o papel de protagonista nesse jogo, influenciando cada vez mais positivamente o sistema através de suas decisões, unificando a jurisprudência, privilegiando a duração razoável do processo.

ABSTRACT

Modern societies have undergone major transformations with the advance of globalization and technological innovations. These changes impact social relations, the economy and the legal order of countries. Since the 1988 Constitution, new ways of interpreting law have emerged, giving greater security and harmony to the system. In Brazil, due to greater demands in society and growing fiscal deficits, the judiciary gained relevance by assuming the role of protagonist in this game, influencing the system more positively through its decisions, unifying the jurisprudence, favoring the reasonable duration of the process.
