RESUMO

Buscar-se á, mediante a presente pesquisa, uma análise jurídica e subjetiva da pacta sunt servanda e da cláusula rebus sic stantibus, tendo em vista o princípio “the code is law”, que rege os smart contracts. Assim, as premissas assentadas para a análise dar-se-ão a partir de hipóteses legais e doutrinárias dos smart contracts, em razão da necessária atenção aos aspectos jurídicos consolidados e tão caros às relações contratuais contemporâneas quando implementadas novas tecnologias, buscando-se na referida coleta de dados e teses, mediante um ensaio dialético indutivo, expor a problemática da relativização de cláusulas em sistemas fechados como os da tecnologia blockchain e smart contracts, alicerçando-se nos registros e na compreensão da automação dos contratos, incorrendo-se obrigatoriamente na compreensão da tecnologia blockchain e smart contracts, bem como dos princípios contratuais: pacta sunt servanda e cláusula rebus sic stantibus.

ABSTRACT

Search It will be through this research, legal analysis and subjective of pacta sunt servanda and rebus sic stantibus, because of the "the code is law" which governs the contracts smart. Therefore, the consolidated premises for the analysis will be based on legal and doctrinal assumptions of smart contracts, due to the necessary attention to the consolidated legal aspects and so expensive to contemporary contractual relations when new technologies are implemented, seeking in the referred data and thesis collection, through a dialectical inductive essay, expose the problem of relativization of clauses in closed systems such as blockchain technology and smart contracts, based on the records and understanding of contract automation, incurring necessarily in the understanding of blockchain technology and smart contracts, as well as the contractual principles: pacta sunt servanda and rebus sic stantibus clause.
