OS DIREITOS DA PERSONALIDADE NO EXERCÍCIO DA LIBERDADE SINDICAL E O REFLEXO NA FACULTATIVIDADE DO PAGAMENTO DO IMPOSTO SINDICAL, SOB ENFOQUE DA REFORMA TRABALHISTA

Resumo

RESUMOOs direitos da personalidade são frutos de uma complexa evolução histórica que resultou em centrar o direito no homem. Assim, a partir do reconhecimento de que o homem é sujeito de direito e, ao mesmo tempo, o fim do direito, pôde-se enxergar os direitos com a perspectiva dos direitos de personalidade. Dentre os direitos da personalidade está presente o reconhecimento da liberdade como direito inerente ao ser humano, sendo que uma das formas do exercício da liberdade é por meio da liberdade sindical. Assim, este artigo demonstra algumas situações onde a ofensa à liberdade sindical significa também uma ofensa aos direitos de personalidade.

ABSTRACT

The rights of the personality are the fruit of a complex historical evolution that resulted in centering the right in the man. Thus, from the recognition that man is a subject of law and, at the same time, the finaly of law, rights can be seen with the perspective of personality rights. Among the rights of the personality is the recognition of freedom as an inherent right to the human being, one of the forms of the exercise of freedom is through freedom of syndication. Thus, this article demonstrates some situations where the offense of freedom of syndication also means an offense against personality rights.
