O EMPREGADO HIPERSUFICIENTE SOB A PERSPECTIVA DO DIREITO FUNDAMENTAL DA IGUALDADE E DA CONVENÇÃO 111 DA OIT

RESUMO

A reforma trabalhista efetivada no ano de 2017 inovou ao criar a figura do empregado hipersuficiente, permitindo que este tenha maior autonomia nas negociações junto ao empregador. Neste artigo, utilizando-se do método dedutivo, após delimitar o que seria o empregado hipersuficiente e as possibilidades de negociação que este poderá realizar, avaliou-se a existência de consonância entre esta nova figura, o direito fundamental da igualdade e a Convenção n.111 da OIT. Por fim, evidenciou-se, em razão das discriminações aplicadas a esse empregado não encontrarem amparo nas exceções possibilitadas pelo direito fundamental da igualdade e pela convenção, a afronta aos alicerces do Direito do Trabalho nacional e internacional.

ABSTRACT

The labor reform implemented in 2017 innovated by creating the figure of the hypersufficient employee, allowing him to have greater autonomy in the negotiations with the employer. In this article, using the deductive method, after delimiting what would be the employee and the possibilities of negotiation that can perform, it was assessed the existence of a consonance between this new figure, the fundamental right of equality and Convention n. 111 of the ILO. Finally, it was shown that, because the discriminations applied to this employee are not supported by the exceptions made possible by the fundamental right of equality and by the convention, it is an affront to the foundations of national and international Labor Law.
