INTERVENÇÃO ESTATAL NA ATIVIDADE ECONÔMICA: A REGULAÇÃO NA ÓTICA DA ESCOLA AUSTRÍACA DE ECONOMIA

O objetivo da presente pesquisa é traçar, em linha geral dada pela ciência jurídica e a partir de revisão bibliográfica, os meios de intervenção do Estado na esfera de atuação e liberdade da iniciativa privada no campo econômico, notadamente a chamada regulação econômica. Ao considerar a possibilidade de obter respostas da ciência econômica sobre o tema, parte-se para a investigação científica dos efeitos da regulação à luz dos postulados estabelecidos pela Escola Austríaca de Economia, em especial, mas não exclusivamente, a partir dos estudos realizados por Ludwig von Mises, reunidos e publicados na obra “Uma Crítica ao Intervencionismo”.

ABSTRACT

The objective of the present research is to establish, in general line given by legal science and from the bibliographic review, the means of intervention of the State in the sphere of action and freedom of private initiative in the economic field, notably a so called economic regulatation. When considering the possibility of obtaining answers of the economic science on the subject, one starts for the scientific investigation of the effects of the regulatation in the light of the postulates defined by the Austrian School of Economy, especially, but not exclusively, from studies realized by Ludwig von Mises, gathered and published in the book "Critique of Interventionism".
