A RESTRIÇÃO AO DIREITO À PROPRIEDADE RURAL DIANTE DO DESCUMPRIMENTO DE SUA FUNÇÃO SOCIAL

RESUMO

O objetivo desta pesquisa foi o de analisar o direito de propriedade rural de acordo com a legislação vigente, levando em consideração a função social da propriedade e sua ligação com a questão ambiental, especialmente no que tange ao direito ao meio ambiente ecologicamente equilibrado. Foi analisado o direito do proprietário que, em princípio, tem poder sobre alguma coisa, podendo dela livremente fruir, dispor, reaver e possuir, em contraste com a aparente restrição desse direito quando do descumprimento da função social. A metodologia utilizada nesta pesquisa foi a do método dedutivo sendo que, quanto aos meios a pesquisa foi a bibliográfica com uso da legislação, doutrina e jurisprudência e, quanto aos fins, a pesquisa foi a qualitativa. Concluiu-se que o direito de propriedade não sofre uma mitigação em razão da possibilidade de desapropriação, mas sim uma condução à melhor utilização da propriedade para que esta alcance a sua função social e possa servir as gerações presentes e futuras.

ABSTRACT

The objective of this research was to analyze the right of rural property in accordance with current legislation, taking into account the social function of the property and its connection with the environmental issue, especially with regard to the right to the environment ecologically balanced. It was analyzed the right of the owner who, in principle, has power over something, being able to freely enjoy, dispose, recover and own it, in contrast to the apparent restriction of this right when the social function is not fulfilled. The methodology used in this research was that of the deductive method and, in terms of the means, the research was the bibliographical one with use of the legislation, doctrine and jurisprudence and, for the purposes, the research was qualitative. It was concluded that the right to property is not mitigated by the possibility of expropriation, but rather a conduit to the best use of property so that it achieves its social function and can serve present and future generations.
